This website is operated by ManhArt Gemstones. Throughout the site, the terms „we“, „us“ and „our“ refer to ManhArt Gemstones.
We offer you this website, including all information, tools and services, on condition that you accept all terms, policies and notices set out here.

By visiting our website and/or purchasing a product from us, you take part in our „Service“ and agree to these General Terms and Conditions („Terms“).

1. Online store terms

By agreeing to these Terms you confirm that you are of legal age in your country of residence, or that you have given consent for a minor dependant to use this website.
Our products may not be used for any illegal or unauthorised purpose.

2. Customer account

Orders can only be placed through a customer account. Registration is free and works by confirming your email address; no password is required.

You are obliged to provide complete and correct information and to keep it up to date. There is no entitlement to the creation of a customer account.

3. Products – gemstones

The gemstones we offer are single pieces (one of a kind). Each piece is available only once.
Product photographs and descriptions are as accurate as possible; nevertheless, colour and rendering may vary between devices.

We reserve the right to offer pieces only to certain customers, regions or countries.
Prices and product availability may change at any time.

Please note: As gemstones are natural products, minimal variations in colour, clarity or cut are characteristics of their natural origin and not defects.

4. Prices and shipping

All prices include statutory VAT.
Shipping costs are shown at checkout.

For deliveries to countries outside the European Union, customs duties, import VAT and clearance fees may arise in the destination country. These are not included in the purchase price and are borne by the recipient. For details, see Shipping.

5. Formation of contract

The presentation of gemstones in our online shop does not constitute a legally binding offer, but an invitation to place an order.
By placing your order you make a binding offer.
The contract comes into effect only upon our confirmation or the delivery of the goods.

6. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days.
Details and a model withdrawal form can be found in the withdrawal policy.

Please note: Because our gemstones are unique pieces, withdrawal may be excluded where goods have been adapted to individual customer specifications.

7. Payment terms

Payments are made using the payment methods offered during the ordering process.
You undertake to provide complete and correct information.

8. Retention of title

The goods remain our property until payment has been made in full.

9. Liability

We are liable for damages only in cases of intent or gross negligence.
For slight negligence we are liable only in the event of a breach of material contractual obligations (cardinal obligations).

10. Final provisions

Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is the registered office of our company, insofar as this is legally permissible.

Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
